Terms of Service — EverStep Footwear

These General Terms and Conditions ("T&Cs") govern all offers and distance contracts between EverStep Footwear (the "Company") and consumers who purchase goods or services at a distance.


1. Definitions


  • Withdrawal period: the period within which the consumer can exercise the right of withdrawal.

  • Consumer: any natural person acting for purposes outside their trade or profession who concludes a distance contract with the Company.

  • Distance contract: a contract concluded between the Company and the consumer within an organised system for distance selling, without the simultaneous physical presence of the parties.

  • Right of withdrawal: the consumer's right to withdraw from the contract within the withdrawal period.

  • CESOP: the EU's central electronic system of payment information for tax monitoring purposes.

3. Scope of application These T&Cs apply to every offer of the Company and to every distance contract between the Company and the consumer. The T&Cs are made available to the consumer before the conclusion of the contract. Deviating terms of the consumer are only valid with the express written consent of the Company.


4. The offer Offers are subject to change unless expressly stated otherwise. All prices include additional costs such as shipping, duties, taxes, and other fees, except where parts of the final price depend on third-party import costs; in that case, this is stated in the product description.


5. Conclusion of contract The contract is concluded as soon as the consumer accepts the offer and fulfils the specified conditions (e.g. payment). The Company confirms the conclusion of the contract promptly by email or another durable medium.


6. Right of withdrawal Consumers have the right to withdraw from the contract within 30 days without giving reasons. The period begins on the day the consumer, or a person designated by them, receives the goods. To exercise the right of withdrawal, the consumer must clearly inform the Company. After withdrawal, the goods must be returned within 30 days. The direct return costs are borne by the consumer, unless otherwise required by law.


7. Refunds in case of withdrawal All payments, including standard delivery costs, will be refunded no later than 30 days after notification of withdrawal, using the same means of payment unless otherwise agreed. Reimbursement may be withheld until the goods have been received or proof of return has been provided. Goods should be returned in their original packaging and in perfect condition where possible.


8. Customs, import duties and VAT (DDU) Shipments outside the EU are made under the delivery condition DDU (Delivered Duty Unpaid). The consumer is responsible for all import formalities and costs, including import VAT and customs duties, handling fees, and compliance with national import regulations. The Company provides standard export documents but does not guarantee their recognition in every country. Incorrect charges caused by an error of the Company will be corrected; costs resulting from consumer error will not be reimbursed. Consumers are strongly advised to inform themselves about import regulations before ordering.


9. CESOP / payment data reporting In accordance with EU rules, payment data may be transmitted to the CESOP system. The Company complies with all legal reporting obligations.


10. Conformity and warranty The goods comply with the contract and legal requirements. Defects must be reported promptly, at the latest within 30 days of discovery. In the event of justified defects, repair, replacement, or refund will be provided in accordance with legal requirements.


11. Delivery and transfer of risk Unless otherwise agreed, deliveries are made within 14 calendar days. Ownership and risk transfer when the goods are shipped. Import formalities referred to in Article 8 are borne by the consumer.


12. Returns and replacements In the event of a defective or incorrect delivery, the Company will arrange a replacement or refund at no cost to the consumer. In the case of voluntary withdrawal, the consumer normally bears the return costs. Refunds are issued no later than 30 days after receipt of the goods.


13. Complaints procedure Complaints must be submitted in writing with order details and supporting documents to info@everstep-footwear.com. The Company acknowledges receipt and responds within 14 days.


14. Liability and indemnification The Company is liable for proven damages in accordance with applicable law. Liability may be limited to the purchase price, to the extent permitted. The consumer indemnifies the Company against claims arising from violations of import regulations.


15. Documentation and compliance Business and shipping records are kept in accordance with legal regulations, for at least five years.


16. Force majeure The Company is not liable for non-performance due to force majeure, such as natural disasters, strikes, trade restrictions, or transport failures.


17. Applicable law and dispute resolution Dutch law applies. Disputes will preferably be resolved amicably; otherwise, the competent Dutch courts will decide, unless mandatory consumer protection law provides otherwise.


18. Changes to the T&Cs The Company may amend these T&Cs. Contracts already concluded remain unaffected, unless otherwise required by law.
